For this event, Caterer agrees to provide the following: (detailed description of what will be provided. Client will provide his/her own menu or choose from the Caterer’s available options etc.
The Parties; Client and Caterer have agreed to the menu attached to this Catering Agreement as” Exhibit A”. Caterer reserves the right to make small changes to the menu if key ingredients are unavailable due to reasons beyond the Caterer’s control.
The following limitations will apply to this right such as requests from client regarding certain type of food served. Vegetarian, sugar free, allergens or other preferences unique to the event. “Exhibit A” will also list the number and types of meals needed with dietary restrictions. Final menu will be fixed and no changes made to the menu _______(number) of hours before event. Menu must be confirmed by _______(date) or a penalty fee of $ ______ will apply.
CO-ORDINATION WITH VENUE: Venue contact name and telephone no. __________________________________________________________________________ Caterer will need to have access to the Venue no later than ______ hours in advance of the Start Time for the event, and ______ hours after the end time for clean-up which is to completed by __________ (time) as set forth by the venue. Clients will make all necessary arrangements to arrange access to venue.
Client is required to pay a deposit of ____________ (amount in dollars if requested) upon signing of this agreement which is (circle one) not refundable or refundable; if Client cancels within _____________ days in advance of said event. A cancellation fee of $__________ (may/may not) apply.
In exchange for the services of this Catering Contract, Client will pay to Caterer $ _________ per person charge attending the event.
In addition; Client may request additional services, with the knowledge that these services will be added to the total cost agreed upon by this contract and must be agreed in writing either as an addendum to this Agreement, or in a separate document. These charges of $ ___________ plus other charges of $ __________ for _______________________________________ are added to the total bill for a grand total of $ ____________ OR if a charge per person does not apply, the base total of $ ___________ plus any additional charges $ __________ for a grand total of $ ___________ will be agreed upon. The balance on the total cost for the Event is due on (end of event or within time frame agreed by both parties) __________________ (date).
Responsibilities for Related Costs: Client is solely responsible for all costs and/or deposits relating to use of the Venue, and for obtaining any necessary authorizations, or other requirement needed by Caterer providing services at the Venue. Insurance and Indemnification: Caterer, has, or will obtain general liability insurance relating to Caterer’s services at the Event. However, Client will indemnify and hold harmless Caterer for any damage, theft, or loss of Caterers’ property occurring at the event, causes by any of Client’s guests. Cancellation: If client needs to cancel, Client must provide written notice to the caterer along with any cancellation fee as noted. Legal Compliance: Caterer will work in compliance with all applicable local health department rules and regulations relating to food preparation and food service. Assignment: This Contract cannot be assigned by either Party without the Other’s written consent. Limitation of Remedies: If Caterer cannot fulfill its obligations under this Contract, Caterer may locate and retain a replacement catering company at no additional cost to Client, or refund Client’s money in full. Resolution of Disputes: The Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advanced written notice and providing the other party with an opportunity to resolve any issues.
ENTIRE AGREEMENT: This document, along with its exhibit/attachments, constitutes the entire agreement between the Parties. Executed on _____________(date)
